Lucky Brand is Not so Lucky
Unfortunately for one hot brand, a lawsuit is filed and they become no-so-lucky.
The Miami brand stated in their lawsuit that the Lucky Brand Jeans are intruding upon their own line with the phrase "get lucky." This lawsuit was evidently brought upon by a lawsuit issued by Lucky Brand against Marcel Fashion Group stating that they were the ones who were going against Lucky Brand's trademark.
A federal judge said Liz Claiborne Inc.'s popular denim line Lucky Brand Dungarees infringes on a Miami company's trademark and ordered the clothier to pay $300,000 in damages. The Marcel company first debuted their "Get Lucky" line in the year 1985, whereas Lucky Brand did not become a trademark until 1991.
At the end of the day, the chief legal officers for Lucky Brand says they will no longer be using the slogan "get lucky" to ensure they don't step on any more toes.
